Legal Lens: Viewing Law Through Ingrum Expertise

When facing criminal charges, one of the biggest decisions is whether to take a plea deal or go to trial. Attorney Jay Ingrum of Ingrum Law Firm breaks down the risks and rewards of each option.

Preparing for War, Praying for Peace

Every case should be prepared as if it’s going to trial, but that doesn’t mean trial is always the best choice. Trials are unpredictable—what might seem like a minor victory in court can still result in unexpected consequences. A lesser charge may still come with a harsher sentence than what was originally offered in a plea deal.

"As a defense attorney, my job is to protect my client not just from the system, but from the unknown," Ingrum explains. "Many people don’t fully understand the risks of a trial. You might win a battle but lose the war."

The Risks of Trial

Trials place the outcome of a case in the hands of 12 jurors—individuals who may interpret the facts in unexpected ways. Even if a defendant avoids the most serious charge, the uncertainty of sentencing can make trials a gamble.

"A jury can be unpredictable," says Ingrum. "They take their role seriously, but you never know what details they will focus on or how they will perceive a defendant. Even if you get a lesser conviction, sentencing is another unknown factor."

The Power of Experience in Negotiations

Seasoned trial lawyers are often able to secure better plea deals. Prosecutors know that an experienced defense attorney won’t hesitate to take a case to court, making them more likely to offer reasonable resolutions.

"If you've never tried a case, it’s harder to get a good offer," Ingrum points out. "If the DA believes you're willing to go to trial, they are more likely to negotiate fairly."

The Bottom Line: Weighing Your Options

A plea deal provides certainty—clients know exactly what they’re agreeing to and what the consequences will be. A trial, on the other hand, is a gamble, where the outcome is uncertain until the verdict and sentencing.

"A bird in the hand is worth two in the bush," Ingrum advises. "Locking in a plea deal eliminates the risk of an unpredictable trial outcome."
